Extended operating hours turned down
TWO planning applications that sought to change business hours and acceptable noise levels at premises at Midmill, Kintore were refused by members of the Garioch Area Committee on Tuesday, (February 26).
The applications by Caledonian Logistics, Lawson Drive, Dyce sought to change conditions that had been set in two planning applications in August and October last year.
Condition 6 of the application to change the use of the premises from General Industrial to Storage and Distribution, stipulated that the hours of operation at the site were restricted to 7am to 7pm Monday to Friday and 8am to 2pm on Sunday. Condition 8 of the previous application for an extension to the warehouse at the site stipulated that noise from the site should not exceed 3dB.
The two applications sought to extend the hours of operation to 5.30am to 7.30pm Monday to Saturday, and to expand the the decibel level from 3 to 5dB.
The application had generated two letters of representation against the proposals and one in support.

The site is described as “mixed” residential and business, with residential properties opposite the application site. Although it is standard Council practice to prohibit operations prior to 7.30am in either mixed or residential areas, the Infrastructure Services (Environmental Health) Service had concluded, following two noise consultants reports, that a 5.30am operational start should not cause any disturbance to residents.

Councillor Hood stated that he was unhappy with the application due to the impact nearby residential properties and could not support it. He said that 5.30am was too early for operational hours to begin, and that he wasn’t convinced regarding the revised noise assessment. Fellow East Garioch Councillor Nan Cullinane agreed, saying she wasn’t convinced that neighbouring residents wouldn’t be affected byb the earlier start.
Councillor Martin Ford also agreed with his colleagues, saying it was a “considerable increase in the level of noise and much earlier operations.”. He said that the applicants appeared to be “seeking to become a lot noisier”.
The committee agreed unanimously to refuse permission for both applications.
